Acceptance of Terms
By using this website or purchasing any products from my online store, you agree to be bound by these Terms of Service. If you do not agree to these Terms of Service, you may not use this website or purchase any products from our online store.
Description of Services
I am a visual artist who creates original, hand painted, acrylic on canvas artworks, among other forms of artworks, and I run an online store (named "gift shop") that offers custom print-on-demand products. These products are printed and shipped to my customers using the service provider Printful Canada. I use Square POS to process online payments and I abide by all Square POS terms of services and privacy policies.
I collect names and emails for the sole purpose of sending newsletters and promotions to my subscribers. I never sell or share personal information. Although personal information is collected when purchasing from my store, I will never send you news letters or promotions unless you have manually signed up for my mailing list subscription.
All content on this website, including but not limited to text, images, and designs, is the property of BLAIR MUELLER ART and is protected by copyright law. You may not reproduce, distribute, or otherwise use any of this content without our prior written permission.
Disclaimer of Warranties
This website and all products sold through my online store are provided on an "as is" and "as available" basis. I make no warranties, express or implied, about the operation or functionality of this website or the quality of any products sold through my online store.
Limitation of Liability
I will not be liable for any damages whatsoever, including but not limited to direct, indirect, incidental, or consequential damages, arising out of or in connection with the use of this website or the purchase of any products from my online store.
These Terms of Service shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada.
Refund & Return Policy
I accept returns for any damaged, custom Print-On-Demand gift shop(store) items only, within 30 days of receipt of the purchased item(s). Products must be returned in their original condition and packaging. In order to process any returns, please contact me first, so we can discuss the issues and make things right.
Since I do not package and ship most items direct from my home, I am not responsible for any damage that takes place due to poor packaging. If something does arrive damaged, please contact me and send a photo of the damage as it was when it arrived. I can reach out to my print-on-demand provider and see if I can have a new one shipped out free of charge. If for whatever reason a replacement cannot be shipped, I can process a refund.
If a refund is the only solution, it will be issued to the original payment method within 10 business days.
The following items are not eligible for returns, refunds, or exchanges:
Original Artworks. For example: Hand painted acrylic on canvas. These are unique and can't be reproduced. However, if you do receive an original artwork damaged, please contact me and I will see what next steps we can take.
